Tiffany and eBay Clash Over Sales of Fake Goods

EBay is a flea market, art gallery and advertising publisher, among other things. Last year, its 95 million users bought and sold 971 million items from luxury cars to trinkets.

It says it defends against fraud through its "feedback" system, whereby buyers and sellers rate one another publicly. And it allows companies to shut down sellers they say are violating their intellectual property rights. Eight-thousand companies have participated under the program, said an eBay spokesman. On its own, eBay also removes auction listings that are in obvious violation of intellectual property laws, he said.

Despite these efforts, online auction fraud is at the top of the list of thousands of complaints received annually by the Federal Trade Commission.

Tiffany and Co. is complaining, but not to the FTC. The luxury goods manufacturer has sued eBay in the Southern District of New York in Tiffany (NJ) Inc. v. eBay Inc., accusing it of trademark infringement by facilitating and promoting the sale of tens of thousands of pieces of counterfeit Tiffany jewelry. The fakery has eroded the reputation of the 150-year-old Tiffany brand, the company says.

The "overwhelming majority" of jewelry items sold and offered on eBay's Web site using the tiffany Rings name are counterfeit, the complaint says. Its research has found that 95 percent of the items are fakes. The issue comes down to whether eBay knew that the items offered for sale at its online auction house were forgeries and what it did to prevent fraudulent sales.

The outcome of the case would have obvious major implications for eBay and the owners of well-known brands, if it is tried to a conclusion. An eBay spokesman said the parties "are in communication" but declined to elaborate. EBay's answer to the complaint is due this month.

Tiffany's claims fall into two categories: direct and contributory trademark infringement.

Direct infringement arises from advertising links that eBay purchased on the popular Internet search engines Google and Yahoo. When users search for "Tiffany" or "Tiffany's" with these search engines, eBay's links appears at the top of the pages.

These links, tiffany Heart argues, lead to sellers that offer counterfeit goods on eBay's site. By advertising them, eBay is violating Tiffany's trademark, it argues.

Contributory infringement is more tricky.

"If someone is knowingly facilitating a counterfeiter, they can be sued as contributors," said Thomas Morrison, a trademark expert at Patterson, Belknap, Webb & Tyler.

Legally there seems to be no question that eBay must remove a known fake from its site. It regularly does so, acting on the word of the manufacturer of the goods in question. It also pursues recidivists, sometimes bringing court action. But it does not screen auctions for counterfeits, leaving that to manufacturers.

Trademark law bans auctioneers, flea market organizers and others from knowingly facilitating the sale of counterfeits. But there is little case law that bears on the specific issue of who should monitor the goods sold on Internet auction sales to learn whether they are counterfeits: eBay or brand name manufacturers.

Although Tiffany is apparently the only company to sue over the issue, it is not the only one that has had problems.

The Callaway Golf Co., which makes high-end golf equipment, was plagued by counterfeit clubs sold on eBay. It worked with the auction company to bring criminal charges against a suspect.

"We get excellent cooperation from eBay," said a Callaway spokesman.

Trademark owners like Callaway that find or suspect a forger contact eBay, which then shuts down the suspect listing.

Callaway also receives the seller's contact information if it wishes to file a lawsuit against the infringer. The process works almost perfectly, said the Callaway spokesman, with few sellers complaining they were wrongly shut down. Sometimes, it leads to a prosecution as was the case with a man found guilty for selling counterfeit Callaway golf clubs in upstate New York last September.

On a typical day, Callaway receives reports from its investigators of three to six suspects operating on eBay. "We watch the Internet auction sites religiously," said the spokesman.

NEW YORK-The name Tiffany hasn't always conjured images of dazzling diamond Tiffany Rings and blue boxes the shade of a robin's egg. In 1837, when Charles Lewis Tiffany and business partner John Young opened the first store on Broadway in lower Manhattan, Tiffany & Co. specialized in stationery, silver flatware and fancy gifts-and generated headlines with non-negotiable prices.

But the nature-inspired rings and Tiffany Necklaces that came later are what made Tiffany America's preeminent jeweler and one of the most respected luxury brands in the world. And as the luxury goods sector of the U.S. economy enjoys a sustained boom that runs counter to the current slowdown, new Tiffany stores continue to open at the rate of five to seven per year.

The Pittsburgh store opening Oct. 10 at Ross Park Mall is the third of four domestic store launches this year, with Columbus, Ohio, becoming the last in November. It will be the first time Tiffany goods are available locally, other than through online orders.

Company executives decided to open a Tiffany in Pittsburgh based on activity from local customers on its Web site. They don't expect the new store to underperform because of online buying.

"Often, customers will browse online and find something they like and go into the store to buy it," said Tiffany spokeswoman Linda Buckley. "They complement each other very well."

At the Ross Park Mall store, merchandise will be displayed atop counters rather than inside windowed cases. At 5,700 square feet, the store will be the size typical of those outside of New York City, but there won't be enough space to display all of Tiffany's products. Products will range from high end to low end, and anything not on display can be delivered to the store.

Tiffany executives said all of the ingredients are in place for the Pittsburgh store to do well.

"Pittsburgh is such a great American city with its own great history. It seems to be a perfect match," said Ms. Buckley, noting that pop artist icon and Pittsburgh native Andy Warhol designed Christmas cards and window art for Tiffany.

Through the ages

Tiffany's history reveals more than a tradition of fine jewelry.

Tiffany designers in 1885 redesigned the Great Seal of the United States that is printed on every $1 bill and they created the invitations for the opening of the Statue of Liberty at Ellis Island in 1886.

The following year, Tiffany introduced the six-prong setting, the first ring design to elevate the jewel above the band to better showcase its brilliance. Tiffany has been the source of elegant White House china for generations, with Lady Bird Johnson commissioning a service in 1968 that featured 90 flowers.

Tiffany & Co. issued a disappointing profit forecast Friday and reported lower U.S. same-store sales over the holidays, signaling that shaky consumer spending was taking a toll on the luxury sector.

The Tiffany Rings retailer, whose shares tumbled 11%, said it was analyzing sales and earnings expectations for its fiscal year beginning next month, given lackluster demand at its U.S. stores and consumer wariness.

"We believe a recent pullback in U.S. spending likely reflected a more cautious attitude among customers about the near-term direction of the economy and related factors," Chief Executive Michael J. Kowalski said in a statement.

Best Buy Co., the largest U.S. consumer-electronics chain, and Restoration Hardware Inc. also said holiday sales growth slowed as rising energy costs and high debt led consumers to trim purchases.

"Holiday sales of Tiffany Bracelets were much lower than expected and a total train wreck," said Howard Davidowitz, chairman of New York-based retail consulting firm Davidowitz & Associates Inc.

U.S. retailers' holiday sales gained 2.2%, the slowest pace in five years, the International Council of Shopping Centers said Thursday. Consumers grappling with declining home values and $3-a-gallon gasoline have limited purchases.

"The consumer has never had more debt; they have tremendous negative wealth effect from housing and huge inflation on energy and food. All of this has reflected itself in a retail debacle," Davidowitz said. "The consumer is completely underwater."

Goldman Sachs analyst Adrianne Shapira wrote in a note to clients that tiffany jewellry shares probably would remain under pressure until the New York-based retailer issued an achievable earnings outlook for the new year. The stock fell $4.52 to $35.80 on Friday. Tiffany cut the top end of profit estimate for the fiscal year ending this month, indicating fourth-quarter results will be less than spectacular. It now expects earnings of $2.25 to $2.28 a share. In November it forecast $2.25 to $2.30 a share.

The estimate excludes a gain from the sale of its Tokyo flagship store and charges for a contribution to the Tiffany & Co. Foundation and a recent deal with Swatch Group to make Tiffany-branded watches. Tiffany cut its full-year sales growth forecast to 14% from 15%.

For the fourth quarter, it forecast a profit of $1.19 to $1.22 a share, excluding the Swatch charge, and sales growth of 8%. The company said it did not see any change in sales trends in January, which can make up 15% to 20% of quarterly revenue.

First of all, look at all the pieces. I have learned the hard way to buy the stuff that looks the plainest. Why? Because it can go with everything and you can wear it for years to come. No point in buying what is "cool" this season when you can spend your money wisely and buy something that is "timeless." Also things that have more bells and whistles tend to not last as long. I have one Tiffany Bracelets that was extremely cool, but after a certain piece kept falling off (the piece that kept the bracelet together) I had to exchange it for a completely different bracelet. They do stand behind their jewelry-thank goodness!!! They nicely explained to me somethings aren't meant to be worn on a day to day basis (which I wear my stuff daily to work and around the house). So when you go to buy something-ask yourself-will I wear this everyday, what type of wear and tear will it get, can this be worn to work-things like that? I would go and talk to them, tell them your budget, how it will be worn, and see what they have to recommend to you. Then go home and sleep on it. I didn't initially do this, but after the broken bracelet incident I now do that before investing in more tiffany jewellry.

As someone mentioned, they will get tarnished if you don't clean them. That seems like a thing to me. When not in use, keep them in the pouches they provide you with and they should not get as tarnished as fast. Also buy a good silver cleaner (ask them to recommend you a brand) or take it back to the store where they will clean it for free. So I hope that helps, and I'm sure you will end up enjoying whatever you buy. Just take the time to buy something you will enjoy for a long time and not regret in the long run.

When it comes to jewelry stores, no store comes close to the brand name reputation and brand image that Tiffany's and Co. has built. The company has made girls across the globe swoon over their Tiffany Bracelets,Tiffany Rings,Tiffany Pendants, Tiffany Earrings,and Tiffany Necklaces and dream of receiving the little blue box that it comes in.

The company has benefited from this "brand image" and is able to charge astronomical markups because of it. Many people walk into Tiffany's because they figure they are the best. Why settle for anything else, right?

I can't argue that Tiffany's has built a fantastic business. Looking at it strictly as a businessman I love what they have done.

But from a customers viewpoint I cringe at the thought of buying from them. When you shop at Tiffany's, you are buying a name.

The diamonds that Tiffany's carries can be found elsewhere for a fraction of the price. I'm talking 40% off.....even as high as 60-70% less if you know what to look for. It's insane how much money these guys ask for their jewelry.

And to make things worse, Tiffany's now grades all their diamonds in-house. When you buy a Tiffany's engagement ring, the grading report for the diamond is issued by Tiffany's themselves - not an independent lab or appraiser. This makes me very uncomfortable! Tiffany's claims they are as strict as AGS or GIA(the two grading labs with the strongest reputations), however this has been reported to not be the case when diamonds from Tiffany's have been sent to GIA or AGS for examination. Obviously, they know that the higher grades the diamond receives - the more they can charge.

The jewelry at Tiffany's is beautiful. I rarely see a Tiffany's engagement ring that I don't think is stunning. However, what is even more stunning is that they get away with charging the prices they do.

There is a ton of money in the diamond industry and Tiffany's is certainly making the most of it. If you are shopping for an engagement ring, or any diamond for that matter, make sure you take the time to do a little research.

Tiffany's isn't going anywhere. People will continue to pay inflated prices for their tiffany jewellry and to be truthful, many will be happy with their purchase because they don't know any better. When you decide to marry, one of the most important decisions will be about your ring. Traditionally, gold, white gold, silver and platinum have been used in wedding bands. But today, the selection of metals is broader, reflecting the change in our tastes and lifestyle. What is Tungsten Carbide?
On its own, tungsten is a very hard and dense metal, with the highest melting point of all metals - 6,100 degrees Fahrenheit. Alone, tungsten is vulnerable to scratches and damage just like any other metal, it gains its extreme hardness by being combined with a carbon alloy, transforming it into tungsten carbide, with a hardness between 8.5 and 9.5 on the Mohs hardness scale. The resulting metal can be designed into wedding band rings that are both visually stunning to please the eye and durable enough to withstand everyday use. These rings can only be damaged through extreme measures, such as abrasion from diamonds or being struck with a hammer.

Choosing Your Tungsten Carbide Wedding Band Tiffany Rings
Make sure you ask your Tiffany jeweler which metal was used in the finishing or binding process. Many manufacturers of tungsten carbide wedding band rings use cobalt as a binder, mostly because it is cheaper to produce. The problem with cobalt is that it bonds with oils in the skin and leeches out of the ring resulting in oxidation. The oxidation appears similar to tarnished sliver, but cannot be removed by polishing or grinding. The better choice is nickel-binder tungsten carbide which is chemically inert, will not oxidize and because it is hypoallergenic, there is no danger of irritation to the skin. Be careful about dealing with a jeweler that doesn't specify that their tungsten wedding bands are made with the nickel binder alloy. Many tiffany jewelry stores do not know which alloy they are selling, and if they don't know, it is most likely cobalt alloy or pure tungsten, which lacks the hardness of tungsten carbide and are easily scratched.

Because of tungsten carbide's extreme hardness, wedding bands made from this metal cannot be sized like gold, silver or platinum rings. When you are ready to purchase, make sure that you take extra care in determining the proper size. In regards to engraving a tungsten carbide ring, it is possible, but the results will be very faint and difficult to read.

Finally, since your tungsten carbide wedding band ring is not indestructible, it makes sense to get a warranty, especially against breakage. Under normal usage there should be little or no wear on both the polish and the textures of your tungsten carbide wedding band ring and you will never need to use your warranty.

A Surprising Visit to Tiffany's

We at Here Comes The Guide recently returned from our big annual meeting, where we regroup and make plans for the next year. We were privileged to stay at the gorgeous Woods Hole at Pebble Beach. What a place to think creatively, and we did.

But, you can't work constantly, right? So, my friends Jennifer, Julia and I took some time out to visit downtown Carmel-by-the-Sea and do some window shopping. As we all know, Carmel is a sweet, charming, and very tony place to shop. And it doesn't get any tonier than Tiffany's.

Frankly, I was just a bit intimidated to casually walk into the famous jewelry store e.g tiffany jewellry, because I wasn't in the market for any bling, and I wasn't dressed to the nines. I thought the salespeople might treat us coolly if we were really just there to browse.

I could not have been more wrong! From the moment we entered the store, every salesperson was as friendly and warm as can be. Instead of vibing us when we confessed that none of us were looking to buy, they opened their cases and suggested we "play jewelry" (their words). What fun! After spending several minutes with us, they cheerfully wished us goodbye, having made us feel welcome to come back anytime.

Even though I didn't buy anything that day, I did fall in love with some aquamarine earrings I tried on while "playing jewelry." I plan to drag my husband back to buy those Tiffany Earrings or just to say "hi" to the delightful staff at Tiffany's Carmel.

My strong advice: If you're in the market for your engagement ring, wedding rings or any of your wedding jewelry, stop by a Tiffany's store. You might be surprised that "it's okay to look." 'Course, I can't promise you won't also buy something Tiffany Heart. Bring your significant other, just in case.
